By liability, I don’t mean that related to the product built with the tool. I do mean that if the tool proves to be other than that represented, and has a flaw causing damages in the form of delaying the product completion, then with a commercial compiler, you have legal recourse to force them to correct the problem or pay remedies.

You sign away pretty much all implied warranties in the EULA and have almost no recourse other than obtaining a refund. The exception is if you can prove intent. Most vendors are good about responding to their customers, and this is a value you receive, but as far as legal recourse goes you might as well use OSS because you have none.
